Bus Involved in Fatal Crash Inspected Week Before Accident

By Pendergast Law on May 14, 2013

A 76-year-old man and his 75-year-old wife were killed in a Washington car accident when a Sound Transit bus struck the SUV in which they were traveling. According to The Seattle Times, the fatal bus accident occurred near Totem Lake Transit Center where I-405 meets 128th Street in Kirkland.

Officials say 35 passengers were aboard the 2008 Gillig bus when it ran a red light, struck the SUV, and rolled downhill half a mile before coming to a stop. The couple in the SUV was fatally injured. The 51-year-old driver of the SUV was treated at a nearby medical center and a number of bus passengers sustained non-life-threatening injuries. The bus driver said that the bus went through the red light because the brakes failed.

A follow-up report in The Seattle Times shows that the bus involved in this fatal crash passed a safety inspection a week earlier. On May 1, a mechanic reviewed a recent complaint that the bus pulled while braking. According to the mechanic’s log, the brake pads were sufficiently thick and the bus did not pull. It is not clear if the mechanic failed to perform an adequate inspection. Sound Transit is cooperating with the Washington State Patrol investigation to determine what went wrong in this case.

All bus companies have a legal obligation to provide a high level of care to their passengers. This includes ensuring that the bus is properly maintained and inspected. When a mechanical malfunction results in a serious injury or fatality-causing accident, it must be determined who was responsible and who should be held accountable for the crash.
