Car crashes beyond your control: where do you stand?

On Behalf of | Aug 1, 2023 | Car Accidents

Washington State welcomed the new year with 2022 data showing the highest number of car crash deaths the state has seen in over 30 years. Most crashes were caused by drug and alcohol intoxication, leading to fatalities. In retrospect, these crashes could have been prevented by exercising reasonable care.

When behind the wheel, drivers must ensure that they are sober, focused on the road and otherwise fit to drive. However, no matter how careful a driver is, they cannot prevent a car accident from happening if the cause is something beyond their control.

When you could not have prevented it

There are several factors that play a vital role in ensuring your safety when driving. Unfortunately, some of those are out of your hands. This includes, but is not limited to, the following factors:

  • Dangerous roads: Potholes, construction debris, insufficient streetlights and other harmful road conditions can result in car crashes.
  • Faulty car parts: Even the best driver cannot prevent a car crash caused by defective auto parts.
  • Careless drivers: Even if you drive safely, other drivers may not exercise the same safety when on the road. For instance, a person driving while intoxicated, distracted or tired can put you at risk of a vehicle collision.

If you analyze closely, others could prevent these circumstances, such as the local government in charge of road construction, auto parts manufacturers and other drivers. But you could not have anticipated these situations, let alone prevent them.

Can you claim compensation for your injuries?

If you find yourself injured in a car crash where you were not at fault, you may be able to seek compensation from your insurance company or pursue legal remedies against the at-fault party. You do, however, need to ensure you are eligible and have the right to bring suit. Additionally, you have to weigh the available remedies to find the best course of action to recover proper compensation and damages.

Recovering compensation for car crash injuries involves meticulously reviewing the circumstances and compiling clear and convincing evidence. A proper understanding of the law and competent representation can help you accomplish these tasks.
